Terms of Service
Effective October 13, 2026
These terms are an agreement between you and Standout Marketing Group LLC ("ServiceBird," "we," "us") for your use of ServiceBird Pro at servicebirdpro.com and app.servicebirdpro.com (the "Service"). By creating an account or using the Service, you agree to these terms. If you use the Service for a business, you confirm that you can bind that business.
1. Your account
You must be at least 18 and provide accurate information when you sign up. You are responsible for keeping your password secret and for everything that happens under your account. Tell us right away at the address below if you think someone else has used your account.
2. The free plan and paid add-ons
The core Service is free. Some features, such as text messaging, are paid add-ons. We will show you the price before you buy. Add-on fees are billed through Stripe and are not refundable except where the law requires. We may change prices with 30 days' notice by email or in the Service.
3. Your data
You own the data you put into the Service, including your leads, customers, quotes, invoices, and messages. You give us a license to store, process, and transmit that data only as needed to run the Service for you, as described in our Privacy Policy. You are responsible for having the right to use the data you enter and for backing up anything you cannot afford to lose.
4. Messaging rules
When you send text messages or emails through the Service, you are the sender. You must:
- Have consent from each recipient that meets the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and any other applicable law.
- Honor opt-outs. The Service stops texting a number that replies STOP, and you must not try to message it another way.
- Not send spam, scams, or messages that are illegal, deceptive, or abusive.
Carriers and messaging providers can block messages that break their rules. We are not responsible for messages that are blocked or delayed.
5. AI features
The Service uses AI to draft replies, summarize conversations, and help you work faster. AI output can be wrong. Review AI-generated content before you rely on it or send it to a customer. You are responsible for anything sent from your account, whether a person or an AI feature wrote it.
If you create an API key in Settings to connect an outside AI assistant, that assistant acts as you inside your account. Keep the key secret. You are responsible for what the assistant does with it. Revoke the key at any time in Settings.
6. Payments through Stripe
Online payments from your customers are processed by Stripe under the Stripe Connected Account Agreement. We do not hold your funds. Payouts, disputes, and chargebacks are handled by Stripe under that agreement.
7. Acceptable use
Do not use the Service to break the law, infringe anyone's rights, send malware, scrape or overload the Service, try to get around security, resell the Service, or store data you have no right to store. We can suspend or close accounts that break these rules.
8. Our rights
We own the Service, its software, and its design. These terms do not give you any rights in them except the right to use the Service as described here. We may add, change, or remove features at any time. We will try to give notice before removing a feature you rely on.
9. Termination
You can close your account at any time in Settings or by contacting us. We can suspend or close your account if you break these terms, if we must for legal reasons, or if we shut down the Service. When an account closes, we handle your data as described in the Privacy Policy. You can request an export of your data before closing.
10. Disclaimer
The Service is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be error free or always available.
11. Limitation of liability
To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, arising from your use of the Service. Our total liability for any claim is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.
12. Indemnity
You will defend and indemnify us against claims, losses, and costs, including reasonable attorneys' fees, that arise from your data, your messages, your customers, or your breach of these terms.
13. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts located in Duval County, Florida, and you consent to their jurisdiction. Before filing a claim, contact us and give us 30 days to try to resolve it.
14. Changes to these terms
We may update these terms. If we make a material change, we will email you or post a notice in the Service at least 14 days before the change takes effect. If you keep using the Service after that date, you accept the new terms.
